Please read these Terms and Conditions carefully before using any Bixmax products or services. By creating an account or using our platform, you agree to be bound by these terms.
1 Acceptance of Terms
By accessing or using any Bixmax product or service — including MobixPOS, GobixPOS, or any future platform under the Bixmax umbrella — you ("User", "Customer", or "you") agree to be legally bound by these Terms and Conditions and our Privacy Policy.
If you are using our services on behalf of a business entity, you represent that you have the authority to bind that entity to these terms. If you do not agree to these terms, do not use our services.
2 Description of Services
Bixmax provides cloud-based and locally-installed business management software, including but not limited to:
- MobixPOS — Point-of-sale software for retail shops and restaurants.
- GobixPOS — Specialized POS and inventory management software for gold and jewelry businesses.
- Related features including dashboards, reporting, ledger management, multi-branch control, and customer support.
Bixmax reserves the right to modify, suspend, or discontinue any feature or service with reasonable prior notice to users.
3 Account Registration
To use our services, you must create an account and provide accurate, complete information. You agree to:
- Provide truthful information during registration and keep it up to date.
- Keep your login credentials (username and password) confidential.
- Be solely responsible for all activity that occurs under your account.
- Notify Bixmax immediately at [email protected] if you suspect unauthorized access to your account.
Bixmax reserves the right to suspend or terminate accounts found to be sharing credentials or used in violation of these terms.
4 Subscription & Payment
Access to Bixmax products is provided on a subscription basis. By subscribing, you agree to the following:
- Billing Cycle: Subscriptions are billed monthly or annually, as selected at the time of purchase.
- Payment: Payments must be made in advance. Bixmax accepts bank transfer, JazzCash, EasyPaisa, and credit/debit cards where available.
- Price Changes: Bixmax may update subscription pricing with 30 days' advance written notice. Continued use after the notice period constitutes acceptance of the new pricing.
- Failed Payments: If payment fails, access to your account may be restricted after a 7-day grace period. Data is retained for 30 days after expiry before deletion.
- Taxes: All prices are exclusive of applicable taxes (e.g., GST/SST in Pakistan). You are responsible for any applicable taxes.
5 Acceptable Use Policy
You agree to use Bixmax services only for lawful business purposes. You must not:
- Use the platform to process, store, or transmit fraudulent, illegal, or harmful data.
- Attempt to reverse-engineer, decompile, or access source code of our software.
- Use automated bots, scrapers, or scripts to extract data from the platform without written permission.
- Share, sell, or sublicense your account access to any third party.
- Use our infrastructure in a manner that disrupts service for other customers (e.g., deliberate overloading).
- Impersonate Bixmax or any of its employees or representatives.
Violation of this policy may result in immediate account suspension without refund.
6 Intellectual Property
All intellectual property rights in the Bixmax platform, including software, design, trademarks, logos, and content, are owned exclusively by Bixmax or its licensors.
- You are granted a limited, non-exclusive, non-transferable license to use the platform solely for your internal business operations during the term of your subscription.
- This license does not permit reselling, redistributing, or building competing products based on our platform.
- Any feedback or suggestions you provide to Bixmax may be used to improve our products without compensation to you.
7 Your Data
You retain full ownership of the business data you upload to or generate within the Bixmax platform (inventory, transactions, customer records, etc.).
- Bixmax acts as a data processor and will not access your business data except for technical support purposes (with your permission) or as required by law.
- You are responsible for ensuring your data complies with all applicable laws, including customer consent where required.
- Upon subscription termination, you may request a full export of your data within the 30-day retention window.
8 Uptime & Service Availability
Bixmax targets a 99.9% monthly uptime for its cloud-based services. Scheduled maintenance will be communicated at least 24 hours in advance.
Bixmax is not liable for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.
9 Termination
Either party may terminate the subscription agreement:
- By You: You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.
- By Bixmax: We may terminate your account immediately if you breach these Terms, engage in fraudulent activity, or fail to pay outstanding balances after the grace period.
- Upon termination, your access to the platform will cease and data will be retained for 30 days before permanent deletion.
10 Limitation of Liability
To the maximum extent permitted by applicable law, Bixmax shall not be liable for:
- Indirect, incidental, special, or consequential damages arising from the use or inability to use our services.
- Loss of profits, revenue, data, or business opportunities.
- Errors, inaccuracies, or interruptions in the service.
Our total cumulative liability to you for any claim arising from these terms shall not exceed the total subscription fees paid by you in the 3 months preceding the claim.
11 Disclaimer of Warranties
Bixmax provides its services on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:
- The accuracy or completeness of any information or reports generated by the platform.
- Fitness of the platform for any particular business purpose.
- That the service will be error-free, uninterrupted, or free from security vulnerabilities.
You use the platform at your own discretion and risk.
12 Governing Law & Disputes
These Terms and Conditions are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.
Any disputes arising from these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the courts of Lahore, Punjab, Pakistan, which shall have exclusive jurisdiction.
13 Changes to These Terms
Bixmax reserves the right to update these Terms and Conditions at any time. We will:
- Notify registered users via email at least 14 days before material changes take effect.
- Update the "Last Updated" date at the top of this page.
Continued use of the platform after the effective date of changes constitutes your acceptance. If you disagree with the updated terms, you may cancel your subscription before the effective date.
